WELCOME TO FUNGUIDE HEREBY REFFERED TO AS (“WE”, “OUR” “US”, OR “FUNGUIDE”) PROVIDES OR OWNS THIS WEBSITE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS OF USE (“TERMS”). PLEASE READ THESE TERMS CAREFULLY BECAUSE THEY GOVERN AND EXPLAIN A CONTRACTUAL AGREEMENT BETWEEN YOU/ PLANNER AND FUNGUIDE AND YOUR USE OF OUR WEBSITES INCLUDING WWW.FUNGUIDE.COM AND ANY OTHER WEBSITES THAT WE MAY LATER OWN OR OPERATE (EACH, A “SITE,” AND COLLECTIVELY, THE “SITES”); OUR MOBILE APPLICATIONS (“APPS”), AND OTHER PRODUCTS AND SERVICES WE MAY LATER OWN OR OPERATE (COLLECTIVELY, WITH THE SITES, APPS, AND THE “SERVICES”).

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. YOUR USE OF THIS SITE IS EXPRESSLY CONDITIONED ON YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS. THESE TERMS ARE LEGALLY BINDING CONTRACT BETWEEN YOU/PLANNER AND FUNGUIDE AND SETS FORTH THE TERMS THAT GOVERN THE LICENSE PROVIDED TO YOU TO RENDER YOUR SERVICES AS ITINERARY PLANNE HEREUNDER. ITINERARY PLANNER REPRESENTS THAT YOU HAVE THE AUTHORITY TO ENTER IN TO THIS AGREEMENT. IF YOU DO NOT AGREE TO THE FOLLOWING TERMS AND CONDITIONS, YOU MUST NOT ACCESS OR OFFER SERVICES. YOU ARE ADVISED TO RETAIN A COPY OF THESE TERMS FOR YOUR RECORDS. PLEASE NOTE, HOWEVER, THAT WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION, TO MODIFY, UPDATE OR AMEND THESE TERMS FROM TIME TO TIME AND POST THE MOST UP TO DATE VERSION ON FUNGUIDE. SUCH MODIFICATIONS AND UPDATES SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING. YOU AGREE TO BE BOUND BY SUCH MODIFIED AND UPDATED TERMS IF YOU ACCESS OR USE THIS WEBSITE AFTER WE HAVE POSTED NOTICE OF SUCH MODIFICATIONS OR UPDATES.

TERMS OF SERVICES

GENERAL

FUNGUIDE is a unique and innovative freelance platform, intended to make traveler/ tourist travel planning easier, intuitive and faster by connecting the FITs (free independent Travelers) with independent Itinerary planer’s through a single, independent marketplace to design a tailor-made itineraries planning. You agree and acknowledge that through this marketplace, FUNGUIDE does not sell anything to anyone and acts as a mediator between travelers/tourists and Itinerary planners.

REGISTRATIO

In order to offer your services as ITINIERARY PLANNER, you must first register and create an account on FUNGUIDE by providing personal detail relating to your name, e-mail and password. By opening an account, you represent and warrant that you will perform your services in compliance with all international and national laws. You agree that the FUNGUIDE has the right to suspend, terminate or cancel the account of any registered service provider at any time on account of misuse or fraudulent use of the account.

UNDERTAKINGS

By creating an account, you agree; (i) to provide us with, complete, accurate and true information; (ii) to ensure that your password remains confidential and secure; (iii) that you are fully responsible for all activities that occur under your Business Account; and (iv) undertake to promptly notify us in writing if you become aware of any unauthorized access or use of your account and/or any breach of these terms. You further undertake not to deal with any user of the Platform outside of the Platform. Violation thereof may result in account suspension and you are responsible for surrendering such earnings to the Company.

Overview (in a nutshell)

Term of service only apply to the registered ITINIERARY PLANNER on FUNGUIDE. Account registration is free. While setting up FUNGUID profile, you are advised to provide true, authentic, accurate, complete and updated information in your profile description and must not create an account for fraudulent or misleading purposes. You are solely responsible for your account confidentiality and security of your password. For Service charges/ payments please read the Payment Terms. Planner’s profile ranking will depend on his performance, reputation and status.

ITINERARY PLANNER’S RESPONSIBILITIES AND OBLIGATIONS

While offering services on this platform, you consent to comply with the following acceptable term and conditions and submit that;

Your profile information, including your personal information, description, skills or location must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. FUNGUIDE also holds the right to confirm your identity or account ownership by verification process for the purpose of using this site.

You are allowed only one active FUNGUIDE account/ business account to prevent fraud and abuse. Creation of multiple accounts is strongly condemned and may result in suspension or deletion of all accounts.

You will not conduct or promote any kind of illegal activity including by way of hacking, drug taking, self harm, human trafficking, terrorism, cracking or distribution of counterfeit software by using this platform;

You are not allowed to contact the users with offers, questions or suggestions by sending multiple unsolicited and deceptive messages, not specifically related to your order;

Your UGC (“User Generated Content”) must not be designed to be hateful, abusive, racist, discriminatory, sexually offensive, obscene, vulgar, defamatory, threatening to another user, promotes violence or hatred against a person or group of people;

You will not infringe third-party rights such as copyright, trademark, trade secret or any other personal or proprietary rights;

You will not personify or misrepresent yourself as another person including celebrities;

You will not transmit malicious content or any content that contains advertising, promotions or commercially-motivated solicitations of any kind or could constitute junk mail, chain letters, pyramid schemes, or other commercial activities;

You are strongly prohibited to transmit adult, sexual or harmful content featuring minors;

You are not allowed to buy or sell accounts while using this site;

While using this platform, you are not allowed to behave rudely, use inappropriate language, bully or harass others; and

Encourage or enable any other individual to do any of the foregoing.

Sharing personal information is strictly prohibited.

You agree that FUNGUIDE holds the complete and unconditional rights to review, alter, modify, edit or delete any content provided by you in our sole discretion without any prior notice. You understand that your communications on the FUNGUIDE are private, confidential, and can be viewed and supplied if law requests.

OWNERSHIP RIGHTS

You agree and admit that this site and all the content found on this website including text, photographs, images, illustrations, audio clips, and video clips, are owned and controlled by us or our affiliates, sponsors and licensors and various third party service providers and distributers (collectively the “Providers”) and protected by copyrights, trademarks, service marks, and/or other intellectual property rights. In addition, the trademarks, logos, service marks, copyrights or other third-party intellectual property displayed or referred to on this website (collectively “the trademarks”) are sole property of the FUNGUIDE and relationship does not constitute a employment agreement.

AGE AND RESPONSIBILITY

You affirm that you are of sufficient legal age to offer services on FUNGUIDE and if you are under the age of 18, you are restricted or prohibited to offer your services. You agree to accept responsibility for all activities that occur under your account or password.

TERM, TERMINATION

Unless terminated earlier in connivance with or subject to the terms, FUNGUIDE reserves the rights to suspend or terminate your account and these terms and conditions and/or the provision of any of the services at any time for any reason, including; (i) any improper use of this site; or (ii) your failure to comply with these terms and conditions; (iii) violation or misappropriation of FUNGUIDE intellectual property.

Feedback

The planner shall not request good or friendly feedback from the clients; this act may cause termination of the account permanently.

Confidentiality

The ITINERARY PLANNER agrees to treat any information received from the Traveller as highly sensitive, top secret and classified material. The Planner agree to (i) keep all such information secret ; (ii) not disclose the information to any third parties;

INDEMNIFICATION

You agree and admit to indemnify, defend and hold harmless the FUNGUIDE and their officers, directors, employees, affiliates, agents, and licensors from and against any claims, liabilities, demands, actions, costs, losses and damages of any kind (including without limitation attorneys’ fees) arising out or resulting from; (i) your service, or (ii) any negligent acts, omissions or intentional wrongdoing by you and (iv) your violation of third party rights, including any intellectual property or privacy rights, or any applicable laws. We are authorized and reserve the right to report any wrongdoing, if and when we become aware of it, to any applicable government agencies.

LIMITATION OF LIABILITY

The PLANNER acknowledges (i) in no event shall we not our affiliates, directors, employees, or agents, have any liability, contingent or otherwise, for any indirect, special, incidental, consequential, punitive, statutory or exemplary damages arising out of or relating to this service, warranty or tort (including negligence) or any other theory of liability, regardless of whether or not such damages foreseeable or which arises out of or is in any way connected with any failure or delay (including, but not limited to the use of or inability to use any component of this site . We shall not be liable and assume no responsibility for any claim arising out of your service, the liability of FUNGUIDE is limited.
